Is it permissible for a husband to separate into a separate dwelling for his wife and his father, despite his father's objection, in order to improve the marital life which has been harmed by the shared dwelling?

1 min readAlso available in العربية

The husband must convince his father to be gentle regarding his right to an independent dwelling for his comfort and that of his wife, and that married life is based on privacy and discretion, and that his wife suffers from living with her husband's brother, before whom she must observe hijab. If the father does not respond, then he may separate into an independent dwelling without his father's consent, because an independent dwelling is a right for the wife guaranteed by Islamic law, and she has the right to refuse living with his relatives due to the harm caused by their awareness of her circumstances. The husband who wrongs her by denying this right should not be obeyed in this matter, because obedience is only in what is good, and there is no obedience to a creature in disobedience to the Creator, while still maintaining filial piety, obedience in what is good, and respect for him.
