If a husband conditions divorce upon his wife's error or dishonesty, and this occurs, an irrevocable divorce ( al-Ba'in) takes place before consummation, and a new marriage contract is required for them to return to each other. However, if the husband did not intend to condition divorce but rather to urge her to be truthful, then no divorce occurs, and he is obligated to offer an expiation for breaking an oath (kaffarat ). The husband erred by asking her about her past; she must conceal what Allah has concealed, and she is not obligated to inform him of her past sins after she has repented.
