If a man swears an oath of divorce with the words, "If I do not leave the house, then you are divorced," and he did not intend a specific time for leaving, then he does not break his oath unless there is a despair of his leaving, such as if he dies or his wife dies. However, if he specified a time for it, then the oath is broken when that time expires and he has not left the house. Disagreement on these matters exists among scholars.
