Does a divorce occur if a man swears to his wife that if she does not come before the Asr prayer, she is divorced, knowing that only two hours remain until the Asr prayer, and the wife tried to come but could not, and the husband is unsure of his intention at the time of the oath and felt remorse before the Asr prayer?

We previously clarified that the ruling on swearing by divorce is like that of a conditional divorce. The fatwa adopted by us is the view of the majority, which states that divorce occurs upon the fulfillment of the condition sworn upon, regardless of whether the husband intended divorce or merely a threat. Since the wife did not arrive at the appointed time, the husband has broken his oath, and the divorce has occurred. His regret does not prevent the occurrence of the divorce.
