If a husband says to his wife, "You are divorced, you are divorced, you are divorced," the Hanafis say that it depends on his intention. If he intended to effect a divorce, then it counts as three divorces, and she becomes irrevocably separated from him. If he intended to emphasize a single divorce, his claim is accepted as a matter of religious conscience, and it is considered one divorce. However, if the matter is brought before a judge, or if the wife becomes aware of it, then it is counted as three divorces, and his claim regarding his intention is not accepted. If his anger was so severe that he lost consciousness and awareness, then no divorce occurs at that time. Such matters should be referred to the courts for adjudication.
