Pledging is permissible according to the Qur’an and Sunnah. The evidence for its permissibility from the Qur’an is the Almighty’s saying: (And if you are on a journey and find no scribe, then a pledge taken [in hand]). And from the Sunnah, what Al-Bukhari and Muslim narrated from Aisha, may Allah be pleased with her: "The Prophet, may Allah’s prayers and peace be upon him, passed away while his shield was mortgaged to a Jew for thirty sa's of barley." There is no difference in pledging between gold and other items, or whether the mortgagee is a goldsmith or not. It is a condition for pledging fungible gold that a mark be placed on it to prevent the mortgagee from borrowing it and returning its substitute when the term is due, unless the gold is placed with a trustworthy person.
