Does a conditional divorce take effect if the wife leaves the house without her husband's permission, whether forgetting or deliberately not informing him, based on the husband's oath: "If you leave at any time without informing me, intending not to inform me because I would prevent you, then you will be divorced; or if you inform me and I prevent you, and you leave against my words, then you will also be divorced"?

The majority of scholars hold that a conditional divorce takes effect if the condition it was suspended upon occurs, and this is the view we issue fatwas according to. Based on this, if the wife leaves the house without her husband's permission intentionally, divorce does not occur if she knows that he does not object to her leaving. The husband is advised to avoid threatening with divorce and to resort to legitimate means of reconciliation when the wife shows defiance. The wife is also advised to fear Allah and obey her husband in what is good, and not to leave without his permission unless it is absolutely necessary.
