Is it permissible for a woman to marry another man if her husband refused to divorce her and she was absent from him for two years?

1 min readAlso available in العربية

As long as a woman is under the marital bond of her husband and he has not divorced her, it is not permissible for her to marry anyone else. If she marries, her marriage is invalid, and she is considered an adulteress. A woman is not allowed to seek divorce except for a legitimate Shar'i reason. If such a reason exists, it is preferable for the husband to grant her khul' (divorce at her request in exchange for compensation). If he refuses, she has the right to refer the matter to a Shar'i judge. Reconciliation between the spouses is always preferred.
