Does a divorce take place if a man says to his wife, "If you repeat that word again, you will be divorced," and then, a week later, while pregnant and forgetful, she repeats the word?

If a husband conditions his wife's divorce on her repeating a certain word, and she repeats it forgetfully, the divorce does not occur. This is the apparent view of the Shafi'i school and one narration from Ahmad, and it is the preponderant opinion. Accordingly, the wife remains under the husband's marital bond. One must be cautious about swearing by divorce in the future, as it is forbidden. Pregnancy does not prevent the occurrence of divorce by the consensus of jurists.
