Is it permissible for a woman who has obtained a Khulʿ to observe her waiting period (ʿiddah) in a country other than her husband's? Is she obligated to observe the ʿiddah in the marital home? Is it permissible for her to remain with her husband in the same house while adhering to the prescribed Islamic dress (ḥijāb)? Does the ʿiddah end with the cessation of menstruation or with purification from it? What are the implications of irregular menstruation?
It is not permissible for a woman to seek divorce or khul’ unless there is a legitimate reason. Some scholars are of the opinion that the original ruling on divorce is prohibition, except out of necessity. If khul’ occurs, the woman who sought khul’ must observe the waiting period ('iddah). The majority of scholars believe that her 'iddah is three menstrual cycles. She must remain in the marital home. However, according to the Hanbalis, a woman in an irrevocable divorce (ba'in) may observe her 'iddah wherever she wishes within her city, but she may not travel. It is permissible for her to share the same residence with her husband if it is spacious enough, provided there is no private seclusion (khalwah). She is not permitted to travel before the 'iddah expires, except out of necessity. The 'iddah ends upon purification from the third menstrual cycle.
