If a man divorces his wife with three pronouncements in a single utterance, the majority of scholars hold that all three divorces take effect, and the wife becomes unlawful to him until she marries another husband. They base their argument on the decision of Umar ibn al-Khattab, may Allah be pleased with him, to enforce such a divorce. Others hold that it counts as a single divorce, and he can take her back as long as she is within her waiting period (iddah), or by a new marriage contract after the iddah. They base their argument on the hadith of Ibn Abbas, may Allah be pleased with both of them, which states that during the time of the Prophet, peace be upon him, Abu Bakr, and the first two years of Umar’s caliphate, three divorces were counted as one. They also cite the story of Abu Rukanah. This latter opinion is what Sheikh Ibn Baz and Sheikh Ibn Uthaymeen have issued fatwas on, and it appears to be the position adopted by the Sharia judge, which means that after the waiting period ends, he cannot take her back except with a new marriage contract.
