Is it permissible for a husband to take back his wife after divorcing her with a single, revocable divorce, given that the wife stipulates for her return that the husband hit his sister because of a word she uttered five years ago?
The husband has a greater right to his wife during the revocable waiting period ( raj'iyyah), and he may take her back without her consent being a condition. If he takes her back, she legally returns as his wife. It is not permissible for the wife to insist on hitting the husband's sister merely for a word, nor is it permissible for the husband to obey her in that; rather, he must reconcile between them. It is permissible for the husband to lie to his wife for the sake of reconciliation, such as telling her that his sister regretted what she said, while exercising patience and wisdom, seeking Allah's pleasure. Matters of divorce and reconciliation should be referred to the courts.
