Does the guardianship of a father who curses the Divine Self and the Messenger (peace be upon him) fall, and is it permissible for the right of guardianship to transfer to another man who is not a relative to marry off the girl?

If it is established that the girl's father cursed Allah and His Messenger, he has exited the fold of Islam by the consensus of scholars. His guardianship over his daughter is forfeited due to his disbelief, and the guardianship transfers to the next in line from the 'asabah (agnates), such as the brother. If there is no brother, then her paternal uncle, then her paternal cousin, otherwise the judge will marry her off. He must be advised to repent. Note that this does not mean ruling on the man's apostasy definitively (as a specific individual), as that is the prerogative of the judge.
