A gift becomes effective during the lifetime of the donor, and it is valid as long as the donor is not suffering from a death-bed illness, and the donee takes possession of it. Justice must be observed in gifting among children, so either the male is given the same share as the female, or twice her share. Scholars have differed regarding the possession of a gifted house: is it a condition to empty it of the donor's belongings or not? The Malikis, Shafi'is, and Hanbalis hold that emptying the house is obligatory, while the Hanafis believe it is not obligatory for a father to empty the house belonging to his minor son. If the gift does not achieve justice, the donor must complete the share of whoever received less than their due right.
