How is an inheritance divided among a mother, three sons, and two daughters?

If the deceased left only those mentioned, then the mother receives one-sixth due to the presence of a lineal descendant, based on the Almighty’s saying: "And for his parents, each of them the sixth of what he left if he has a child." The remainder goes to the sons and daughters by way of ta'sib (residuary heirship), with the male receiving the share of two females, based on the Almighty’s saying: "Allah instructs you concerning your children: for the male, what is equal to the share of two females."

Thus, the inheritance is divided into forty-eight shares: the mother receives eight shares, each son receives ten shares, and each daughter receives five shares.

We emphasize that matters of inheritance are serious and complex, and a mere fatwa is insufficient. Rather, it is necessary to refer the matter to the Sharia courts for investigation and to ensure there is no other heir, or wills, or debts, or rights that take precedence over the rights of the heirs.
