What must a young man do to rid himself of the sin of an 'urfi marriage with a girl he consummated it with, knowing that he wanted to marry her, but her family stipulated difficult conditions for a legitimate marriage? Should he accept her and marry her, or should he separate from her?
A Muslim must not trifle with matters of marriage due to their gravity. Among invalid marriages is a man marrying a woman without the permission of her guardian (wali), as narrated from the Prophet, peace and blessings be upon him: "There is no marriage except with a guardian," and "Any woman who marries without the permission of her guardian, her marriage is invalid." Therefore, the questioner's marriage to this girl without her guardian is invalid, and one must repent from it. It is not permissible for him to be alone with her or to enjoy her. There is no harm in marrying her after her guardian's approval and ensuring her womb is clear (istibra' rahim).
