You are permitted to pay the fare to the driver of the car. The matter reverts to his intention in saying "by haram." It is irrelevant whether the driver knows or not. So, if someone swears not to eat a man's food, and then eats bread that his son brought out from the house of the one he swore against, and he (the swearer) was unaware, he has broken his oath.
