What is the ruling on an employer performing Hajj while failing to pay employees their due wages, and on his statement that payment will be made later after Hajj, knowing that he possesses other assets?
If the company owner is indebted to people and to his workers for financial rights, then it is obligatory for him to settle his debts before performing Hajj, because Hajj is not obligatory for him due to his inability if the money is not enough to pay off the debt and perform Hajj simultaneously. He must pay his workers' rights immediately, for the Prophet, peace and blessings be upon him, said: "There are three whose opponent I will be on the Day of Resurrection: a man who gave by My name and then betrayed, a man who sold a free person and consumed his price, and a man who hired a worker, benefited fully from him, but did not give him his wages." His statement that the salaries are not from him but from his company is void; he is responsible for them, and his liability is occupied with them until he pays them or their rightful owners forgive him.
