What is the ruling on entering websites that contain sections and links for fashion, knowing that the husband has sworn an oath of divorce not to enter fashion websites only, and is it permissible to transgress the oath if the husband forgets it?

The majority of scholars hold that swearing by divorce – whether it is intended as a divorce, a threat, a prevention, an encouragement, or an affirmation – results in divorce upon breaking the oath. This is the prevailing fatwa. The reference for determining what was sworn upon is the intention of the one who swore.

If the husband says: "I will not know you again," and he intends divorce by it, then if you enter the forbidden websites, divorce occurs. However, if he intended something other than divorce, then divorce does not occur unless you transgress by entering the websites and he does not carry out his threat.

The ruling depends on the husband's intention. If the husband has forgotten that he uttered the divorce, but you are certain of it, then what you know is what matters. If he has not divorced you twice before, there is no harm in you remaining with him, even if you are certain that this divorce has occurred; because reconciliation happens simply by intercourse according to some scholars.

It is recommended to present the matter to the Sharia court or to trustworthy scholars.
