Is it permissible for a husband to marry another woman for the purpose of having her live with his mother, in the event that his first wife refuses to live with her, especially given that the wife considered this a threat to her?

A wife has the right to an independent dwelling, and she may not be deprived of it except with her consent. If the husband's intention in giving his wife the choice between waiving her right to a separate dwelling or him marrying another so she can live with his mother is to secure her consent, then this is permissible.

Polygyny is permissible on condition of justice in dividing time among the wives, unless one of them waives her right. It is possible to combine showing filial piety to one's mother with good companionship to one's wife by providing the wife with a spacious dwelling that includes a separate wing.

If it is not possible to combine these, and the husband does not have multiple wives, then the husband can stay near his mother for three days or less, and one night and day with his wife. This is because the preferred opinion of many scholars regarding the initial division of time is that the wife has one night out of every four nights, and the days follow the nights.

Al-Muwaffaq in Al-Mughni said: "The initial division of time is obligatory. If he has one wife, he is obliged to spend a night with her one out of every four nights, unless there is an excuse. If he has wives, then each of them has one night out of every four."
