What is the jurisprudential ruling concerning dealing with a husband who is not religiously observant and who rejects his wife's hijab after both of them have performed the Hajj, and is divorce the solution in this situation?

A husband abandoning prayer is a great danger and a major sin. Some scholars even consider one who abandons prayer, even out of laziness, to be an unbeliever. There is no meaning in him having a "white heart" while he neglects the obligatory prayer, for a righteous heart ensures its owner's uprightness and adherence to religious duties.

The husband should be advised and reminded of Allah Almighty. This advice should come from those whose words are likely to be heeded, such as scholars and virtuous individuals. If he does not return to righteousness, there is no good in continuing to live with him, and she should seek divorce or khul'.

The hijab is an obligation upon the Muslim woman, and it is not permissible to neglect it or to obey the husband if he wishes to prevent her from wearing it, for there is no obedience to a creature in disobedience to the Creator.
