What is the Shar'i ruling regarding a father's bequest of one-third of his estate to his daughter, knowing that this was motivated by a desire to punish another son, and what is the Shar'i stance for the children in this situation? And what are the duties of the brother towards his siblings who have taken a stance against him because of his position on the bequest?
The money saved by the father for his children must be divided among the heirs, each according to their rightful share. No one is permitted to claim it exclusively, for Allah Almighty says: (And do not transgress. Indeed, Allah does not like transgressors), and because the Prophet, peace and blessings be upon him, said: (The property of a Muslim is not lawful except with his willing consent).
The will made by the father in favor of one of the heirs is unlawful and cannot be claimed, due to the saying of the Prophet, peace and blessings be upon him: (Indeed, Allah has given every rightful person his right, so there is no will for an heir).
The questioner should continue to advise and guide, and reconcile between the parties, and clarify to her sisters that they are only asking for their rightful share of the inheritance, and that claiming the will is not permissible. She should also try to persuade her brother kindly to give his sisters their rights.
She must remain steadfast in truth and not be bothered by the blame of blamers. Everyone is called upon to fear Allah and abandon discord.
