Divorce occurs by breaking an oath sworn by it or by making it conditional on an event, and no expiation (kaffara) is required for it. Sheikh al-Islam Ibn Taymiyyah held that if it was not intended to effect a divorce, then it falls under the ruling of an oath sworn by Allah, and expiation for an oath is required (feeding or clothing ten poor persons, or freeing a slave; if one cannot find these, then fasting), and it is permissible to perform the expiation before or after breaking the oath.
