Is it permissible for a woman to marry a man who kissed her on the lips, if her husband divorces her and he proposes to her?
We congratulate the questioner on the blessing of Islam and faith, and she should learn the matters of her religion. If her husband divorces her and her waiting period (iddah) expires, she is permitted to marry someone she accepts, provided he is a suitable candidate, but with conditions:
1. It is not permissible to seek divorce except for a legitimate reason, such as bad treatment, or an aversion that prevents giving the husband his rights, based on the hadith: "Any woman who asks her husband for divorce without legitimate cause, the scent of Paradise will be forbidden to her." However, it is permissible if the wife intensely dislikes her husband to an unbearable degree, as this prevents her from fulfilling his rights, as did the wife of Thabit ibn Qays.
2. It is not permissible to seek divorce in order to marry another man, nor is it permissible for that man to incite her to divorce, as this is forbidden instigation (takhbib), which is a major sin. Some scholars have gone as far as to permanently prohibit her marriage to the one who instigated her, based on the hadith: "He is not of us who instigates a woman against her husband." Takhbib is corrupting a woman against her husband.
