How is the inheritance of a deceased father divided among his heirs (3 sons, 2 daughters, and a wife), taking into account that one of the sons lives in part of the house and participated in its construction, another son built his apartment with his own money, while the third son contributed to the building of his apartment, and that an apartment was sold during the father's lifetime?

The wife inherits one-eighth due to the existence of a lineal descendant, as Allah Almighty says: "But if you have a child, then for them [the wives] is one eighth of what you leave, after any bequest you [may have] made or debt." The remainder goes to the two daughters and the three sons by way of ta'sib (residuary heirship), with the male receiving the equivalent of the share of two females, as Allah Almighty says: "Allah instructs you concerning your children: for the male, what is equal to the share of two females." The property left by the father should be appraised and divided among the heirs, or sold and its price distributed. If the inherited money is something that can be counted, measured by volume, or weighed, then it is divided. If it consists of goods or real estate, it is appraised and its value divided, or it is sold and its price distributed. As for the construction of the apartments, the situation differs based on the time of construction (before or after death) and its conditions (with the father's consent, a gift, a loan, an endowment, assistance, or partnership). It is recommended to consult scholars directly or refer the matter to the Sharia court for consideration.
