Does a divorce take effect if the husband swears by saying: "By Allah, the Most Great, if I get to know another woman, then you are divorced," and then he offers expiation for the oath without his wife's knowledge, and returns to getting to know other women?
The majority of scholars hold that if a husband makes his wife's divorce conditional upon a condition, and that condition is fulfilled, the divorce occurs, regardless of whether the husband intended to enact the divorce or merely intended a threat, emphasis, or prevention. This is the established fatwa. Some scholars, such as Ibn Taymiyyah, are of the view that if the husband did not intend to enact the divorce, but rather intended a threat, emphasis, or prevention, then the divorce does not occur, but he is liable for an expiation for breaking an oath (kaffarat yamin).
Accordingly, the established fatwa with us is that if your husband breaks his conditional oath concerning "getting to know another woman," his divorce from you occurs. The breaking of the oath happens by him getting to know another woman, according to his intention with his oath, as Al-Buhuti said: "If his wife makes him swear not to marry another woman while she is his wife, and he swears to her, and intends something of what we mentioned... then his intention is valid; because his wording can bear it."
However, according to the view of Sheikh al-Islam Ibn Taymiyyah, his divorce does not occur upon breaking the oath, as long as he intended emphasis by his oath and did not intend for the divorce to occur.
If the divorce is considered to have occurred, and it does not complete the three divorces, then the husband has the right to take you back during your iddah (waiting period), and your consent or knowledge is not a condition for the validity of the revocation. It is obligatory for the husband to fear Allah and beware of illicit relationships.
