When is intention not considered in a metaphorical divorce, especially for someone with obsessive thoughts?

Divorce by way of an implicit statement (kinayah) does not occur unless accompanied by a firm intention free from hesitation. So, if a person utters a kinayah of divorce with such an intention, their divorce is effective. The intention considered valid for a kinayah of divorce must be firm; if it is accompanied by hesitation, it is not given any weight. As for the person suffering from obsessive-compulsive disorder (waswas), their divorce does not take effect—even a clear (sareeh) one—if they utter it under the influence of the waswas and do not genuinely intend it. Thus, it is even more fitting that their kinayah of divorce does not take effect if they are not firm in their intention.
