Why did the Prophet (peace and blessings be upon him) not mention argumentation in the Hadith: "Whoever performs Hajj and does not engage in sexual intimacy nor commit sins will return as if on the day his mother gave birth to him," whereas Allah Almighty mentioned it in the Noble Quran in His saying: "So no sexual intimacy, nor sin, nor argumentation during Hajj"? And does argumentation not diminish the reward of Hajj?

Abu Hayyan mentioned that the Prophet (peace be upon him) conditioned the forgiveness of sins upon abstaining from that which corrupts Hajj, namely sexual intercourse, referred to as "rafath," and sins, expressed as "fusooq."

And Allah's saying: "And there is no Jidal (disputing) in Hajj" is to complete what the pilgrim should be upon, which is to dedicate his actions to Hajj and avoid quarreling.

The prohibited "jidal" (disputing) is that by which its practitioner seeks to establish falsehood and seek prestige, and this falls under "fusooq" (disobedience). As for the "jidal" intended to establish truth, call to Allah, and defend the Sunnah, it is not prohibited. The apparent meaning of Al-Subki’s statement is that disputing diminishes the reward of Hajj.
