Does a divorce exacted under duress take effect, and is this type of divorce valid?

Divorce under duress is not effective, unless the duress is lawful, such as threatening the husband with a punishment he deserves. However, if the threat is unlawful, such as imprisonment or severe beating without just cause, the divorce does not take effect. For duress to be established, the coercer must be capable, the coerced must predominantly believe that harm will occur, and the harm must be significant, such as prolonged imprisonment or death. It is advisable to present the matter to the Sharia court or to trustworthy scholars.
