As for the nullification of his guardianship due to his فسق (open sinfulness), scholars have differed on this. The majority are of the opinion that it is not nullified, while Al-Shafi'i held that it is. The more preponderant view is that فسق does not nullify guardianship unless it is linked to betrayal of the one being guarded, in which case the guardianship of the dissolute father over his daughter is nullified, unless he repents.
