Assuming ihram from the miqat is a duty among the duties of Hajj, it is not waived by forgetfulness or ignorance. Whoever fails to assume it must offer a sacrifice (dam). It was obligatory for whoever passed the miqat intending to perform the rituals to return to it and assume ihram from there. If one assumes ihram after passing the miqat, they must offer a sacrifice for failing to assume ihram from the miqat. This is the opinion of the majority of scholars, who cite the statement of Ibn Abbas (may Allah be pleased with them both): "Whoever forgets something from his ritual or abandons it, let him spill blood (offer a sacrifice)."
