What must a person do who entered Mecca with the intention of Hajj on the first of Dhul-Qi'dah, passing through the Miqat without consecrating himself in Ihram, and is he obliged to consecrate himself in Ihram for Umrah from Al-Taneem or offer a fidyah, and should he combine Hajj with Umrah?

Whoever passes the Miqat intending to perform a ritual (Hajj or Umrah) without having entered into ihram must return to it to assume ihram from there if possible, and in that case, nothing is incumbent upon him.

If he is unable to return due to an excuse, such as illness, fear, or having missed the opportunity, he should assume ihram from his current location, and a damm (sacrifice) becomes obligatory upon him, to be slaughtered in Makkah and distributed among its poor.

If he has no excuse and does not return, but assumes ihram from his current location, his ihram is valid, though he incurs a sin and the damm becomes obligatory.
