Does a divorce occur with the words "Divorce on me, you have no blood" if the husband did not intend divorce but rather insult or abuse in a state of anger?

The fatwa we adhere to is that an oath of divorce results in divorce upon breaking it, whether the intention was divorce, threat, prevention, urging, or emphasis. This is the view of the majority of scholars.

Shaykh al-Islam Ibn Taymiyyah, however, holds that the ruling on an oath of divorce that is not intended to effect divorce, but rather to threaten or emphasize something, is the same as an oath by Allah. Thus, if the oath is broken, the swearer must offer expiation for an oath, and no divorce occurs.

Therefore, if you swore an oath of divorce while knowing that what you described your wife with was false, then your divorce has occurred.

But if you swore an oath believing what you described your wife with was true, then no divorce occurs, and nothing is binding upon you.

Know that the permissible oath is by Allah Almighty, whereas swearing by divorce is among the oaths of the wicked.
