If it is established that the intoxicated person caused the accident, and there was no way to avoid it, then there is no liability on the part of the one who collided with him. The one who caused the accident is responsible for what resulted from it, including blood money (diyya) and expiation (kaffarah), whether he was intoxicated or not, because the intoxicated person is held accountable for his actions. If the damage is less than one-third of the blood money, it is to be paid from the intoxicated person's wealth. If it exceeds one-third, it is to be paid by his 'aqila (male relatives on the father's side). If the intoxicated person dies or his car is damaged, it is considered without compensation, because he brought destruction upon himself.
