Is it considered an ongoing charity (Sadaqah Jariyah) if money was paid to build a mosque, but the person who received it embezzled it and the mosque was not built?

If money is given with a sincere intention to build a mosque as an ongoing charity (Sadaqa Jariyah), and then the person who received the money defaults, and the donor is unable to retrieve their money from them, it is still considered an ongoing charity for the donor. This is because the donor fulfilled what the Sacred Law commanded them to do. The consideration for a charity lies in expending it during one's health and while one has control over their wealth, as stated in the Hadith (definition): "or a charity he expended from his wealth during his health and life, which reaches him after his death."
