Is the husband's statement: "Go to your family's home and seek divorce from there" considered a divorce? And what is the ruling of Islamic law regarding the divorce of a woman who has been divorced twice previously, and then her husband told her: "Go to your father's house," knowing that she has been residing in her family's home for nine months without maintenance and does not wish to return to him?

A husband's statement to his wife, "Go to your parents' house," is a kinayah (allusion) of divorce, by which divorce does not occur unless there is the intention [of divorce]. The husband is the one to whom the knowledge of this intention refers. If he did not intend divorce, then the wife is still under his marital bond, and he must fulfill her rights. However, if she desires divorce due to her dislike of him, and not because of any harm inflicted upon her, then she may separate from him through khul' (divorce at the wife's instance, usually by returning the dower). In case of dispute, the matter is referred to the Sharia court.
