Is it permissible for an employee who saw his colleague stealing to swear on the Qur’an regarding the recent theft, and to lie in his oath about previous thefts that Allah had concealed and whose reality he does not know, based on a fatwa from one of his colleagues?

The answer included several points:

1. The employee erred by immediately reporting his thieving colleague. The correct approach would have been to advise him first, and if he did not desist, then to inform the authorities.

2. Swearing by the Mus'haf is like swearing by Allah, and expiation is required if the swearer breaks his oath.

3. Your colleague's fatwa permitting the thief to lie about his previous thefts is invalid. He must speak truthfully and confess if he is made to swear an oath, then repent and return the stolen items to their owners.
