Divorce only applies to a wife. Therefore, divorce of a fiancée or a woman who is irrevocably divorced (bā’in) does not take effect due to the absence of a marital relationship. A bā’in woman is one who was divorced before consummation, or a revocably divorced woman whose waiting period (iddah (definition)) has ended, or a woman who has sought divorce through khul‘, or one who has been given three divorces. If a woman is divorced while she is bā’in, the divorce does not take effect.

If a divorce occurs before the marriage contract, it has no effect. If it occurs after the contract but before consummation, it is an irrevocable divorce (bā’in). If it occurs after consummation, it is a revocable divorce (raj‘ī). The second divorce, if it occurs while the wife is in a state of bā’in separation, is not counted. Otherwise, it is counted as a divorce. The divorce pronounced by an angry person takes effect as long as he is conscious.

The third divorce via telephone is subject to what has been said about the second. If it is preceded by two effective divorces, it becomes an irrevocable major divorce (bā’inah kubrā), and she is not lawful for her husband until she marries another man in a marriage of genuine desire. The fact that the divorce occurs via telephone does not affect its validity.
