Will my wife be divorced by triple talaq if I swore by that concerning her return home, and she returned without me ordering her to do so?

The majority of scholars, including the four schools of thought (madhahib), hold that a conditional divorce takes effect when the condition upon which it is suspended is met. So, if you made a divorce of three pronouncements conditional on your wife's return to a specific house, and she returned, then a triple divorce has occurred according to the majority, and she becomes unlawful for you until she marries someone else.

Shaykh al-Islam Ibn Taymiyyah and those who agreed with him were of the opinion that if your intention was to threaten or prevent, then only an expiation for breaking an oath (kaffarat yamin) is required of you. However, if you intended divorce, then a single divorce takes effect.

Divorce does not occur if you intended that your wife should not return to your house until after a certain period, and then she returned after that period expired, because the intention specifies the oath.

Your being of an irritable disposition does not prevent the divorce from occurring if the condition is violated, unless you uttered it while in a state of extreme anger such that you did not comprehend what you were saying; in that case, nothing is held against you.
