Is it permissible for the owner to lease his land to a tenant who will build a restaurant and cafeteria on it that may serve shisha (tobacco)?

The basic principle is the permissibility of leasing land to someone who will use it for lawful purposes. However, if it is highly probable that it will be used for disobedience (to God), then it is not permissible, based on the Almighty's saying: "And cooperate in righteousness and piety, but do not cooperate in sin and aggression." This is also because the rent would be unlawful, as it involves aiding in disobedience. If the lessee openly commits acts of disobedience, the owner is obliged to forbid them from it, as part of enjoining good and forbidding evil.
