Will a triple divorce take effect if I do something I swore upon Allah's Book not to do without my wife's knowledge or consent, but then I did it with her consent and knowledge, especially if the matter goes against Allah's command?
If a man swears by triple divorce not to do a certain thing without his wife's knowledge and consent, and then he does that thing, there are two scenarios for him: 1. If he intended to swear by Allah to abandon the act, he has broken his oath, and he must offer expiation for an oath (feeding ten poor people, clothing them, or fasting three days if unable), and it is better for him to offer expiation. 2. If he intended to suspend his wife's triple divorce upon doing that thing, and he did it, then his wife is divorced with three divorces according to the majority of scholars. Some scholars held the view that a suspended divorce intended for threat only necessitates expiation for an oath. Ibn Taymiyyah was of the opinion that "you are divorced with three divorces" counts as a single divorce.
If he did not do the thing, or did it with his wife's knowledge and consent, he has not broken his oath. It must be known that divorcing with three divorces at once, whether suspended or immediate, is contrary to the Sunnah.
