How can the inheritance be divided in a Sharia-compliant manner among the father, his brothers, and his sisters, especially after the death of some heirs and the refusal of others to accept the Sharia-compliant division, taking into consideration the previous responsibility of the father and his brothers for their sisters?

First: Dividing the inheritance as Allah has commanded is an obligatory duty that must not be deviated from, because He Himself undertook this matter and threatened those who disobey Him by saying: (These are the limits [set by] Allah, and whoever obeys Allah and His Messenger will be admitted by Him to gardens [in Paradise] under which rivers flow, abiding eternally therein; and that is the great attainment. And whoever disobeys Allah and His Messenger and transgresses His limits - He will admit him to a Fire, abiding eternally therein, and he will have a humiliating punishment.) An-Nisa/13-14.

Second: Whoever wishes to divide an inheritance must identify the living heirs present at the time of the deceased's death. If the grandfather passed away after the grandmother, the grandfather's inheritance is divided among his sons and daughters (the living heirs), with the male receiving the share of two females. However, if the grandmother was alive when the grandfather passed away, she takes one-eighth of her husband's inheritance, and then the remainder is divided among the sons and daughters, with the male receiving the share of two females.

Third: If one of the sons passes away, his inheritance is divided among his living heirs. For example, if he leaves behind three daughters and a wife, in addition to his brothers and sisters, his inheritance is divided as follows: the wife receives one-eighth. The daughters receive two-thirds. The remainder goes to the brothers and sisters, divided among them with the male receiving the share of two females.
