Does divorce take effect after the husband pronounces it three times with the intention of silencing his wife, and after his previous threat to divorce her if she did not bring receipts for a trust, knowing that they have children?
A conditional divorce takes effect when the condition is met, according to us, whether the husband intended to enact the divorce or not. The divorce has indeed occurred due to the wife's failure to bring the receipts within the specified time. If you took her back during her waiting period () through verbal declaration or intercourse, she has returned to you, and one divorce counts against you. As for the last divorce, if anger made you lose consciousness, the divorce does not take effect; otherwise, it does take effect according to us. Repeating the word of divorce without intending to enact more than one divorce only results in one divorce. If the divorce has occurred only twice, it is permissible to take the wife back during her iddah. It is advisable to present the matter to trustworthy scholars in the questioner's country.
