Regarding the ruling on divorce: 1. The first divorce many years ago: If he took her back before the expiry of her iddah (waiting period) or remarried her after her iddah, then she returned to his marital bond, and it was counted as one divorce. Otherwise, the divorce did not take effect. 2. Uttering a triple divorce oath: Possibility of an immediate triple divorce: She becomes unlawful to him according to the majority of scholars (including the four madhhabs) until she marries another husband. A triple divorce uttered on the same day is considered void after the marital bond is severed. However, according to the madhhab of Ibn Taymiyyah, a triple divorce counts as only one, and he may take her back before the expiry of her iddah or renew the marriage contract, but the opinion of the majority is more preponderant. Possibility of a triple divorce suspended on a condition: It does not take effect before the condition is met. According to the majority of scholars, a major irrevocable divorce (baynunah kubra) occurs in both scenarios. However, according to the madhhab of Ibn Taymiyyah, a triple divorce occurring after a suspended divorce counts as only one, and he may take her back before the completion of her iddah. If he violates the condition of the suspended divorce, he must pay an expiation for an oath (kaffarat yamin) if he did not intend divorce. If he did intend divorce, and it was during a period of purity in which he did not touch her, then the divorce that completes the three divorces becomes binding, and she becomes unlawful to him until she marries another husband.
