Is the testimony of a smoker permissible in a marriage contract, especially if he admits that smoking is a sin but is trustworthy and truthful, and is he considered among the people of justice?

Smoking is forbidden because of the harm it entails. Persisting in it, despite recognizing its prohibition, is considered persistence in a minor sin, and persistence in a minor sin elevates it to a major sin. However, if the good deeds of a person who insists on smoking outweigh their sins, they are considered upright by some scholars, and their testimony is accepted. As for the testimony of a transgressor (fasiq), Abu Hanifa accepts it in marriage contracts, contrary to the majority of scholars.
