Is the declaration of faith, "Lā ʾilāha ʾillā Allāh" (There is no god but Allah), accepted from an original disbeliever when they fall into the hands of Muslims during a defensive war, or is it only accepted during an offensive war?

If a disbeliever says "There is no god but Allah," it is accepted from him, and it is not permissible to kill him. In the Hadith (definition), it is stated: "Did you kill him after he had testified that there is no god but Allah? Why did you not cleave his heart?" In another Hadith: "Fight them until they say 'There is no god but Allah.' If they say it, their blood and wealth become sacred, except by its right." And the Prophet, peace and blessings be upon him, said: "I have been commanded to fight the people until they testify that there is no god but Allah and believe in me and in what I have brought. If they do that, they have protected their blood and wealth from me, except by its right, and their reckoning is with Allah."
