Are hashish and opium intoxicants (khamr)?
Scholars have unanimously agreed on the prohibition of hashish, opium, and narcotics due to their severe harm, and based on the saying of the Messenger of Allah, peace and blessings be upon him: "The Messenger of Allah, peace and blessings be upon him, forbade every intoxicant and every substance that causes languor."
Al-Qarafi and Ibn Taymiyyah reported the consensus on their prohibition.
They differed on their punishment: whether it is a prescribed punishment (hadd) or a discretionary punishment (ta'zir). Some jurists held that the one who consumes them should be given a discretionary punishment less than the prescribed one, while others were of the opinion that its prescribed punishment is the same as that of alcohol.
