This statement from the husband is not an explicit divorce; rather, it is a metaphor or a promise of it. If he intended it as a promise, then no divorce occurs by the wife going to her family, and he is not obligated to fulfill this promise. However, if he intended it as a condition, then if he did not intend to effect a divorce by her departure, it does not occur. But if he did intend to effect it, she is divorced upon her departure, according to the majority of scholars. Shaykh al-Islam Ibn Taymiyyah holds the view that he has the right to retract the condition.
