What is the ruling on the return of the first suitor to his fiancée who is now engaged and has had her marriage contract (kitab) written to another man, before the latter has consummated the marriage with her? And is instigating discord before consummation the same as after it?

The man is obligated to sever his relationship with the girl and not corrupt her against her husband by proposing to her, as this is a forbidden act of incitement. Ibn Taymiyyah said: "As for a married woman, it is not permissible to propose to her, neither explicitly nor implicitly. Rather, that is incitement of the woman against her husband, and it is among the vilest of sins." If the girl is divorced, then there is no impediment to proposing to her.
