The incident involving Hamza occurred before alcohol was prohibited. Hamza was killed on the Day of Uhud, and the prohibition of alcohol came after the Battle of Uhud, so he was excused. The meaning of "thamil" is intoxicated. The Prophet, peace and blessings be upon him, excused Hamza and did not impose the hadd punishment on him because alcohol had not yet been prohibited at that time. It is narrated that he made him pay the price of the two camels. Scholars have unanimously agreed that an intoxicated person is liable to guarantee whatever he destroys.
